Family mediation is a process where an independent, professionally trained mediator helps families resolve disputes by facilitating communication and guiding difficult conversations. Unlike a judge, who imposes decisions, the mediator assists parties in negotiating mutually acceptable solutions. Mediation can address issues such as:

The Isle of Man Courts encourage family mediation, typically requiring individuals to attempt mediation before resorting to using the court process. Mediation is generally more cost-effective, quicker, and less stressful than court proceedings. Mediation doesn’t always solve everything in dispute, but can often narrow the issues so that Court is only intervening with certain points that cannot be resolved in any other way.

When Mediation May Not Be Appropriate 

Mediation may not be suitable if there’s a history of domestic abuse or if urgent decisions are needed. However, in most family disputes, mediation remains an effective and beneficial solution. If you have concerns about being in the same room as the other party you can ask your mediator about  ‘shuttle mediation’. This may allow you to still enjoy the benefits of the mediation process without having to face the other party in person.
