We are able to deal with a relationship breakdown quickly and efficiently. If it is the breakdown of a marriage a client may decide to proceed by way of a Separation Agreement and wait for a period of 2 years prior to issuing Divorce Proceedings. Alternatively, an immediate Divorce Application may be issued if the client has sufficient grounds (e.g. adultery or unreasonable behaviour etc). Each family situation is considered individually and advice is tailor made to suit the particular situation.

What do I need to bring with me when seeking advice?

Will I need to go to court?
Hannan Law are committed to resolving family problems by mediation where possible, and achieving an amicable settlement outside of Court. This can save both time and cost as well as avoiding the stress of a Court date. However, if it is not possible to achieve a resolution outside of court, then our team are fast and effective litigators who can represent you through this process.
What is the process of getting a divorce?
The process of getting a divorce is complex and will depend on your individual circumstances. Generally, an application for divorce must be filed with the Isle of Man Court and there are specific requirements to prove that the marriage has broken down irretrievably. Upon filing, your spouse will receive notification of the application and then have the opportunity to respond.
Does my spouse need to agree for me to get divorced?
No, your spouse does not need to agree in order for you to get divorced. If your spouse does not respond within a certain amount of time after being served with the divorce papers then it will be considered uncontested, and the court will proceed to grant the divorce.
What should I do if my spouse is refusing to sign divorce papers?
If your spouse is unwilling or unable to sign the divorce papers, you can still proceed with a court application for an uncontested divorce. The Court may need to make an Order before it proceeds to grant the divorce.
Do I need a legal representative if I am getting a divorce?
It is not mandatory to have a lawyer when you are getting divorced, however it can be beneficial in complex cases where there are substantial assets or matters relating to children involved. A family law specialist will be able to provide clear advice and guidance on how best to protect your interests throughout the process. While people are typically concerned about the price of legal representation during a divorce, the price of losing more than your fair share of assets outweighs that for most.
